IMPORTANT – READ CAREFULLY: By accessing or using any of the information available on this site (collectively, the “Licensed Information”) provided by ATTOM Data Solutions, LLC (“ATTOM”), you agree to be bound by these Terms of Use and ATTOM’s Privacy Policy located at: https://www.attomdata.com/privacy/. If you do not agree, do not access or use the Licensed Information.
1. LICENSED INFORMATION AND SERVICES
The Licensed Information may include, without limitation, information related to ATTOM’s assessor data, recorder data, AVM data, loan model data, pre-foreclosure data, neighborhood data, boundary data, and other data types. ATTOM may, in its sole discretion, update or modify the Licensed Information at any time. "Services" means ATTOM’s graphical user interfaces, methods, processes, and related services, including hardware, software, access to Licensed Information, technical assistance, and support services.
2. PERMITTED USE
You agree to use the Licensed Information solely for the purpose of evaluating whether to enter into a data license agreement with ATTOM. This limited license is granted solely for your internal evaluation and does not permit any other use, including but not limited to commercial exploitation or revenue generation. No license or right in or to the Licensed Information is granted, except as expressly provided herein.
3. RESTRICTIONS
You agree not to:
- Remove or modify any copyright or proprietary notices within the Licensed Information;
- Use the Licensed Information in any unlawful manner or in a way that harms ATTOM, its affiliates, or third parties;
- Modify, copy, create derivative works of, decompile, reverse engineer, or otherwise attempt to access the source of the Licensed Information;
- Redistribute, sell, rent, lease, sublicense, or transfer the Licensed Information to any third party;
- Use the Licensed Information in production systems or for deriving commercial value.
4. TERM AND TERMINATION
These Terms of Use begin on the date ATTOM first provides you access to the Licensed Information (the “Effective Date”) and continue until terminated by ATTOM. Upon termination:
- You must immediately cease accessing or using the Licensed Information;
- Delete and purge all Licensed Information and derivative works (if any) from your systems and files;
- Confirm in writing to ATTOM that you have completed the foregoing steps.
You agree not to access or use the Licensed Information after termination.
5. CONFIDENTIALITY AND OWNERSHIP
The Licensed Information is the valuable proprietary information of ATTOM and/or its licensors. You acknowledge that ATTOM and its suppliers retain all right, title, and interest in and to the Licensed Information, including all intellectual property rights. You agree to maintain the confidentiality of the Licensed Information and to take all reasonable steps to prevent unauthorized use or disclosure.
6. NO OFFER OR RELIANCE
The Licensed Information is provided for informational and evaluation purposes only. It does not constitute an offer, warranty, or commitment by ATTOM. You acknowledge that you are not relying on the Licensed Information as a guarantee of future data availability, performance, or commercial terms.
7. DISCLAIMERS / WARRANTY
ATTOM does not verify the accuracy, completeness, or authenticity of any third-party or public source data included in the Licensed Information. The Licensed Information may contain errors or omissions.
THE LICENSED INFORMATION IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS. ATTOM AND ITS LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR DATA ACCURACY.
8. LIMITATION OF LIABILITY AND INDEMNITY
You assume all responsibility for your use of the Licensed Information and agree to indemnify, defend, and hold harmless ATTOM and its suppliers from any claims, damages, losses, or expenses (including attorneys’ fees) arising out of such use.
IN NO EVENT SHALL ATTOM OR ITS SUPPLIERS BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. MONITORING AND COMPLIANCE
ATTOM may monitor or audit your use of the Licensed Information to verify compliance with these Terms of Use. You agree to cooperate fully with any such audit upon reasonable notice.
10. EXPORT COMPLIANCE
You agree to comply with all applicable export laws and regulations. You shall not export, re-export, or otherwise transfer any Licensed Information in violation of such laws.
11. GOVERNING LAW
These Terms of Use shall be governed by the laws of the State of California, excluding conflict of laws principles. Copyright and trademark matters shall be governed by U.S. law and applicable international treaties. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Orange County, California and waive any objection to such jurisdiction.
12. TERMS AND CONDITIONS OF THE SERVICES
Only you and your authorized employees (“Authorized Employees”) may access the Services. You must:
- Prevent unauthorized access to the Services;
- Maintain control over any credentials (e.g., passwords or unique URLs) issued;
- Refrain from sharing passwords or allowing concurrent logins under the same credentials;
- Notify ATTOM of any unauthorized access or misuse.
ATTOM reserves the right to revoke credentials, deny access, or modify the Services at its sole discretion. A maintenance window is reserved from 10:00 p.m. to 12:00 a.m. PT on weekdays, during which service may be unavailable.
All intellectual property in the Services remains the sole and exclusive property of ATTOM and its licensors.
13. CHANGES TO TERMS
ATTOM may revise these Terms of Use at any time. Continued use of the Licensed Information following such changes constitutes your acceptance of the revised terms.
14. RESERVATION OF RIGHTS
All rights not expressly granted herein are reserved by ATTOM and its licensors.
15. ENTIRE AGREEMENT
These Terms of Use constitute the entire agreement between you and ATTOM regarding access to and use of the Licensed Information and supersede all prior agreements or understandings. You may not assign these Terms without ATTOM’s prior written consent.
16. SEVERABILITY
If any provision of these Terms of Use is held unenforceable, the remainder shall remain in full force and effect, and the invalid provision shall be deemed modified to the minimum extent necessary to be enforceable.
17. SURVIVAL
Sections 1, 5 through 11, and Sections 13 through 17 shall survive the termination of these Terms of Use.
